Terms of Service

1. Acceptance of terms

These terms are a binding agreement between you and the operators of WantThis (“we”, “us”). By creating an account or using the service at wantthis.co.uk or our mobile apps, you accept these terms and our Privacy Policy. If you do not agree, do not use the service.

2. The service

WantThis is a wishlist and gift list service that lets you create lists, add items, share them with others, and track prices. The service is currently provided free of charge and is supported by affiliate commissions on retailer links (see Affiliate Disclosure). We may change, suspend, or discontinue features at any time.

3. Your account

• You must be at least 13 years old to create an account.
• You are responsible for keeping your password and authentication tokens secure.
• You are responsible for activity that happens on your account.
• You agree to provide accurate registration information and to keep it up to date.
• One person, one account. Don't share login credentials.

4. Acceptable use

When using WantThis you agree not to:

• Upload content that is unlawful, defamatory, obscene, hateful, or infringes anyone's rights.
• Use the service to spam, harass, or impersonate others.
• Probe, scan, or test the service's security without our written permission.
• Scrape, harvest, or copy data from the service except via our published APIs and within their rate limits.
• Use bots or automation to create accounts, fake clicks, or inflate affiliate metrics.
• Interfere with other users' ability to use the service.
• Reverse-engineer or attempt to extract source code, other than the parts we have open-sourced.

We may remove content, suspend accounts, or refuse service to anyone who breaks these rules, at our reasonable discretion.

5. Your content

The lists, items, descriptions, images, and other content you add to WantThis (“Your Content”) remain yours. By adding Your Content to the service you grant us a worldwide, royalty-free, non-exclusive licence to host, display, and transmit it solely so we can provide the service to you and to people you share lists with.

You confirm that you have the rights to share any content you upload. If you delete Your Content or your account, the licence ends, except for content already shared with others or required to be retained for legal reasons (see Privacy Policy §8).

6. Affiliate links

Some retailer links on WantThis are affiliate links — when you click through and buy, we may receive a small commission at no additional cost to you. We disclose this clearly. See our Affiliate Disclosure for the full picture.

7. Third-party retailers

When you click through to a retailer you are transacting with that retailer under their terms. We are not party to your purchase. We are not responsible for product accuracy, pricing, delivery, returns, customer service, or any dispute arising from your transaction with a third-party retailer.

8. Intellectual property

The WantThis name, logo, branding, software, and content (other than user-generated content) are owned by us or our licensors. You may not use our trademarks without our written permission. Nothing in these terms transfers any of our intellectual property rights to you.

9. Disclaimer of warranties

The service is provided “as is” and “as available”. To the maximum extent permitted by law, we make no warranties, express or implied, about the service, including warranties of merchantability, fitness for a particular purpose, or non-infringement. Price tracking estimates are informational only — we cannot guarantee retailer prices or availability.

10. Limitation of liability

Nothing in these terms excludes or limits our liability for death or personal injury caused by our negligence, for fraud, or for any other liability that cannot lawfully be excluded or limited under UK law.

Subject to the paragraph above, we are not liable to you for any indirect, incidental, special, consequential, or punitive damages, or any loss of profits, revenues, data, goodwill, or other intangible losses arising from your use of the service. Our total liability to you for any claim arising out of or relating to the service is limited to £100 (one hundred pounds sterling).

11. Indemnity

You agree to indemnify and hold us harmless from any claim, loss, liability, or expense (including reasonable legal fees) arising from your breach of these terms, your misuse of the service, or Your Content infringing the rights of a third party.

12. Termination

You can stop using the service and delete your account at any time. We can suspend or terminate your account if you break these terms, if your use creates legal risk for us, or if we discontinue the service. If your account is terminated for breach, we may retain limited records as required for legal or fraud-prevention reasons.

13. Changes to these terms

We may update these terms from time to time. We will notify registered users of material changes via email and update the “last updated” date above. Continuing to use the service after a material change means you accept the new terms.

14. Governing law and disputes

These terms are governed by the laws of England and Wales. Any dispute arising out of or in connection with these terms or your use of the service is subject to the exclusive jurisdiction of the courts of England and Wales, except that nothing in this clause limits any statutory consumer protection rights you have where you live.

15. Severability

If any part of these terms is found to be unenforceable, the rest will continue in force as if the unenforceable part were not included.
